Terms of Use

Welcome to Simpler Times ("App"). These Terms and Conditions ("Terms") govern your use of the Simpler Times app, a mobile application that allows users to download and customize wallpapers for their iPhones. By downloading or using this app, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the app.

Use of the App

Simpler Times allows users to:

Download wallpapers designed to look like the front of various iPod models.
Customize iPod wallpapers with stickers.
Download and use wallpapers that have been customized within the app.

The app includes 15 ready-to-use wallpapers and allows for customization of iPod models across 15 different color variants.

Customization and Personal Use

All wallpapers and customizations made within the app are for personal use only. You may not distribute, modify, resell, or commercially exploit any wallpapers or images generated by the app in any way.

No User Accounts

The app does not require or allow for the creation of user accounts. No login, sign-up, or personal data is required to use the app.

Offline Use

Simpler Times operates completely offline and does not collect any personal information or require an internet connection for use.

Payments

Simpler Times is available for free download, but a one-time payment is required to unlock the ability to download wallpapers. The payment is processed through the App Store. Once the payment is made, you will be able to access the full functionality of the app, including downloading customized wallpapers.

Refunds

Due to the nature of digital goods sold on the Apple App Store, all refunds shall be handled via the App Store itself.

Acceptance of Terms

By using the App, you agree to abide by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and the App. If you are using the App on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

Prohibited Activities

You agree not to:

Use the app for any illegal or unauthorized purpose.
Attempt to reverse-engineer or otherwise extract source code or other proprietary data from the app.
Attempt to gain unauthorised access to the App's systems or networks.
Modify, adapt, or hack the App.
Violate any applicable local, state, national, or international law while using the app.

Intellectual Property

The App and its content, including but not limited to text, graphics, logos, images, software, and trademarks, are the intellectual property of the App's owner. You may not use, reproduce, modify, or distribute any of the App's content without the owner's express written consent.

Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without any warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. While we strive to ensure the app operates smoothly, we do not guarantee uninterrupted or error-free use. We do not guarantee that any generated wallpaper will meet your specific requirements.

Limitation of Liability

The App shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, including but not limited to, issues related to device compatibility, app functionality, or wallpaper downloads.

Intellectual Property Disputes

We respect the intellectual property rights of others and expect our users to do the same. If you believe that your copyright or trademark rights have been violated by content on the app, please contact us at help@signworth.co.in with the following information:

A description of the copyrighted work or trademark that you claim has been infringed.
A description of the content that you claim is infringing and its location within the app.
Your contact information, including your name, address, email address, and phone number.
A statement by you that you have a good-faith belief that the use of the disputed content is not authorized by the copyright or trademark owner, its agent, or the law.
A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright or trademark owner or authorised to act on behalf of the owner.

User Feedback and Suggestions

We welcome feedback and suggestions from our users to improve the app. By submitting any feedback, suggestions, or ideas to us, you acknowledge and agree that:

We have the right to use and implement any feedback, suggestions, or ideas you provide without any obligation to compensate you.
Your submissions do not establish a confidential relationship with us, and we are not obligated to keep your submissions confidential.

Indemnification

You agree to indemnify and hold harmless the App, its developers, and affiliated parties from any claims, damages, liabilities, and expenses (including attorney's fees) arising out of or related to your use of the app, your violation of these Terms of Service, or your violation of any rights of another.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Dispute Resolution

Any dispute arising out of or relating to these Terms of Service or your use of the app shall be resolved through arbitration administered by the Indian Council of Arbitration (ICA). The arbitration shall be conducted in accordance with the rules of the Indian Council of Arbitration (ICA) then in effect, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.

Changes to Terms

The App reserves the right to modify or replace these Terms at any time. The most current version of the Terms will be posted on the App. Your continued use of the App after any changes to the Terms constitutes acceptance of those changes.
